Punjab: Show original ownership in revenue records, says panel

TNN | Jan 2, 2020, 04.12 AM IST

CHANDIGARH: Noticing that possession of waste lands, riverbeds and fallow lands across Punjab continued to be shown in ‘khasra girdawari’ on the name of a person “surreptitiously”, the Punjab revenue commission has recommended that possession should be recorded in favour of the original owner like the municipal corporations, municipal councils, nagar councils or village panchayats.
Illegal encroachment of government land has been a serious issue in Punjab. Even forest and wildlife minister Sadhu Singh Dharamsot had in April 2018 claimed that 28,600 acres of forest land was under illegal possession of “politically influential persons” across the state.

“It has generally been noticed that when a person other than the owner is in occupation of land in some capacity or the other like tenant or unauthorised occupation, his possession continues to be shown in ‘khasra girdwari’ even though the general rule is that ‘possession follows title’,” observed the commission headed by Justice S S Saron (retired).

The commission added it affects proprietary rights of owners which include even the state government, municipal corporations, municipal councils, nagar councils and gram panchayats particularly in respect of ‘shamlat deh’ land.

Khasra girdawari is a revenue document in which the patwari (revenue officer), on the basis of harvest inspection done twice a year, makes entries like name of land owner, land cultivator, land or khasra number, area of land, nature of land like cultivated or non-cultivated, source of irrigation, crop sown and revenue rate.

The revenue commission said the Supreme Court has held in ‘Gurunath Manohar Pavaskar vs Nagesh Siddapa Navalgund’ case, “a revenue record is not a document of title. It merely raises a presumption in regard to possession. Presumption of possession and/or continuity thereof, both forward and backward, can also be raised under Section 110 of the Evidence Act”.

In another case, Nair Service Society Ltd Vs KC Alexander, the Supreme Court held: “Possession may prima facie raise a presumption of title no one can deny but this presumption can hardly arise when the facts are known. When the facts disclose no title in either party, possession alone decides.”

The apex court had also made the law clear in “Chief Conservator of Forests vs Collector”, holding that it certainly does not mean that because a man (or government body) has title over some land, he necessarily is in possession of it. It in fact means that if at any time a man with title was in possession of the said property, the law allows the presumption that such possession was in continuation of the title vested in him. Therefore, the revenue commission has recommended to the Punjab government, “In respect of fallow lands or lands where no cultivation is done, the possession should invariably be recorded in favour of the owner as shown in the revenue record.”

After Sunam MLA Aman Arora flagged encroachments on government land across the state, the Director, Local Bodies, has asked all municipal corporations, committees, councils and Nagar panchayats to submit a list of such properties and names of persons in possession of these properties.

The civic bodies have been asked to submit details of properties encroached upon.

In his questionnaire, the Sunam MLA also asked the state government to provide details of any provision or process underway for removing the encroachments. The MLA also sought to know from the state government whether or not it has any plans to regularise the encroachments.

"Encroachments on government land have been a contentious issue in this area. A list of encroachments has never been compiled nor any effort taken to remove illegal occupation," said Sadhu Ram, president Lok Manch, Kotkapura.

Properties of civic bodies are covered under the definition of public premises under Section 2(e) of the Punjab Public Premises Land (Rent and Recovery) Act, 1973, and encroachments on lands can be removed under the Act.

Besides encroachments on the land of municipalities, there is a proliferation of religious shrines that become footholds for illegal settlements. there are also many cases of land grabbing where illegal squatters have encroached on footpath and pavement.

"Most of the encroachers take the plea that land on which their buildings were built were never in possession of the municipalities and they had become the owner of the land by purchasing it from another person. The reality is the municipality is the absolute owner of its land even if it has not taken its possession," said a senior functionary in Municipal Committee Kotkapura.

Gurgaon: Police files case against illegal cowshed after Khattar takes note [01.04.2018]

Kartik Kumar | Hindustan Times | 1 April, 2018

Gurgaon: The Gurgaon police registered a case against three men for encroaching government land in Choma village near Palam Vihar after the issue was brought to the notice of Haryana chief minister Manohar Lal Khattar during the district grievance redressal committee meeting on Saturday. The Municipal Corporation of Gurugram (MCG) filed a police complaint in the matter immediately after the meeting.

According to MCG officials, Krishna Lamba, a resident of Sector 5 had registered a complaint at the CM window on March 14.

The complaint stated that three men had built their houses, a park and a cowshed (nandigram gaushala) on 7.5 acres of land.

Of this, the ‘nandigram gaushala’ was situated on one acre of land that belongs to the state government.

In its reply, the MCG told Lamba that they had written to the Gurgaon police on several occasions for a police force to carry out a demolition drive, but due to their unavailability, no action had been taken.

Lamba, who was present during the meeting on Saturday, brought this issue to Khattar’s attention. Khattar directed MCG officials to verify whether the concerned property was Panchayat land and accordingly take necessary measures, while lauding Lamba for his courage.

While registering my complaint on the CM window, I had also attached a ₹10 lakh cheque for the state government to encash if my complaint was found to be untrue. The CM has assured me that my cheque will be returned and the matter will be addressed,” Lamba said.

The MCG’s complaint to the police stated that according to a land revenue officer report, more than an acre of civic land had been encroached upon.

“Notices have been issued to the offenders under Section 408 of the Haryana Municipal Corporation Act, 1994. The MCG has also approached the Gurgaon Police for their assistance. The matter will be quickly resolved,” Sudhir Singh Chauhan, Senior Town Planner, MCG, said.

Based on the MCG’s complaint, the Gurgaon police have registered a case against the accused, identified as Surender Mandal, Upender Mallik, and Sunil Gulia—all residents of Choma village.

“Investigations are in progress with the coordination of MCG officials,” Vikram Nehra, Palam Vihar station house officer said.

A case against the three accused has been registered under sections 34, 188, and 447 of the Indian Penal Code and Section 3 of the Prevention of Damage to Public Property Act.

A resolution to sanction expenditure for filling a fresh case under the Punjab Village Common Land Act, 1961, in a civil court regarding 1,033 kanal 19 marla shamlat land at Harlalpur village here was kept pending after a detailed discussion at the Kharar Municipal Council meeting here today. The meeting was held under the chairmanship of Anju Chander. Kharar MLA Kanwar Sandhu was also present on the occasion.

This village was merged with the local municipal council on April 29, 2013. A special meeting was called today to discuss the issue. According to agenda of the meeting, a discussion was held with senior officials regarding various recommendations made by the Justice Kuldeep Singh tribunal regarding this land. The case was decided by the court in the favour of owners earlier.

As per the resolution, 937 kanal 4 marla land stands in the name of various people. As per the government instructions, this issue was discussed with Justice Rajiv Bhalla (retd) and two different civil writs had already been filed in the Punjab and Haryana High Court.

Councillors Gurpream Singh Romana, Kuldip Singh and Pargat Singh opposed the resolution as many villagers were in the possession of the land for the past two decades. They said it was not advisable to file a fresh case in the court as the matter had already been decided by the High Court. Another councillor, Amarjit Singh Panchi, admitted that many influential persons had purchased the land in the village. After a detailed discussion, a five-member committee was formed to get details of the common land belonging to the council.

MLA Kanwar Sandhu gave his advice on the issue. He said many influential persons had encroached upon the common land of villages in Kharar. He asked the MC to get full details of the land and circulate a recent decision of the Punjab and Haryana High Court.

A request for passing a resolution for the transfer of an MC official was also discussed in detail. At the meeting, the person concerned himself said that he was proceeding on leave and would get himself transferred from here.

Kanwar Sandhu, while addressing those present on the occasion, said that he would never tolerate any corruption in the working of the council. He asked MC officials to give full respect to the elected members and work to solve various problems faced by Kharar residents.
