UPON hearing counsel the Court made the following
O R D E R
It is deeply regrettable that in spite of our Order dated 28.01.2011, only the State of Jharkhand has filed an affidavit. We are informed by learned counsel for the States of Chhattisgarh and Karnataka that they would be filing the affidavits on behalf of their respective States during the course of the day.
List again on 27.07.2011. We make it clear that if the affidavits are not filed by other States/Union Territories before the next date of listing, then their Chief Secretaries must be personally present in the Court on the next date of hearing, that is, 27.07.2011.
Mr. R.K. Kapoor, learned counsel, states that only Jagpal Singh, appellant No. 1 in this Appeal, has been evicted, while others are still illegally occupying the property in question. Mr. Kuldip Singh, learned counsel for the State of Punjab, who is present in the Court, is directed to file a reply stating the correct fact in this respect, apart from making a general reply.
All intervention applications are allowed.
Copy of this Order will be supplied to the learned counsel for the parties/intervenors on payment of usual charges. Copies will also be sent forthwith to all Chief Secretaries and Home Secretaries of all the States/Union Territories.
